Eligibility Requirements for an ENS Nomination

The general requirements for a legal nomination application are as follows:

  • The business needs to be actively and lawfully operating in Australia.

  • The position has to be full time and available for two years from the time the visa is granted.

  • The position needs to have a salary that is at least $53,900 per annum at the yearly market salary rate for the nominated occupation.
  • The position must be subject to the conditions of employment that should not be worse than those that apply to Australians working in the exact location.

Eligibility Requirements for the ENS Visa

There are three streams for the ENS visa, and they are:

  • Temporary Residence Transition

The general requirements for this stream are as follows:

  1. You need to have a 457 visa or a 482 visa to work full time in the nominated position for the nominated employer in Australia for at least three years in the last four years.
  2. You need to be genuinely performing the tasks of the nominated position.
  3. You need to be competent in English.
  4. You also need to be under 45 years of age.
  5. You must meet mandatory licensing, registration and professional membership requirements.
  6. You need to satisfy both the health and character criteria for the Subclass 186 Visa.

You need to note that TRT can apply to two types of applicants, with people who used for or had a 457 visa before 18 April 2017 considered under the transitional provisions.

If you and your visa were granted subsequently, you could apply under the program using different exemptions. People who applied after 18 April 2017 need to have their occupation on the MLTSSL and need to work with their sponsor for a minimum of three years.

  • Direct Entry

Direct entry applicants need to have their occupation listed currently on the MLTSSL. Contrary to demonstrating that they worked for their employers for at least three years, they can instead:

  1. Have their skills evaluated as suitable for their chosen occupation by the relevant assessing authorities
  2. They need to have at least three years of post-qualification experience in their particular occupation
  3. They need to be under 45 years of age
  4. They need to have competent English
  5. They must satisfy the health and character requirements.
  • Labour agreement stream

This stream is for the applicants who currently work or have already worked for an employer who is a party to any labour agreement and also sponsored by an employer via a contract.

Can You Include Your Family Members?

Employer Nomination Scheme Subclass 186 visas can also include your family members, but only the immediate family members. The following family members can be eligible for the visa:

  • A de facto partner or a spouse of the same or opposite sex, you need to be able to prove that the relationship is legitimate and that you live together permanently.
  • A dependent or stepchild from a previous or current relationship under the age of 18. Children who are aged 18 to 23 who are unmarried and dependent on their parents can be considered for a family visa.

  • Has nominated earnings or at least equal to the Australian Taxation Office to individual tax income.
  • Resides in Australia as the holder of a particular category visa or a New Zealand Citizen Family Relationship visa and has worked with the nominated employer for two years.
